Long Version

1. The Auction Market shall be under the immediate charge of the auction manager.

2. The auction manager shall be directly responsible to the board of directors of the association. The manager shall be appointed by the board and serve under them at a salary to be fixed by them.

3. It shall be the duty of the auction manager to enforce on the market all rules approved by the board of directors.

4. The auction manager shall have power to make decisions and to enforce the manager's rulings in all cases of controversy not governed by the rules and regulations.

5. The Board of Directors may assign such duties to the auction manager as may be deemed necessary for the proper maintenance and conduct of the market.

6. Any person using the market must agree to comply with the rules herein described, to obey the directors of the auction manager and not interfere with the auction manager or the manager's assistants when they are working in line of their duty.

7. No person shall willfully deface or damage any property of the market association.

8. No persons shall offer their produce for sale at the market in any other place than that designated by the auction manager. They shall keep in line and offer their load in turn, and go from the market at the designated exit.

9. No person shall "cut in" ahead of another previously on the market, unless authorized by the manager or assistants.

10. No persons shall "litter" or deface the ground or buildings by dumping or leaving any papers, packages or objectionable refuse, fruits or vegetables thereon.

11. While the market is designated to sell fruits and vegetables chiefly, any other farm product may be offered for sale if permission has previously been granted by the management.

12. No person shall sell or offer for sale in either open or closed packages any fruits or vegetables which are packed in such a manner that the face or surface shown shall not be a reasonable representation of the contents of the package. Sample or samples shown shall be a fair representation of the rest of the load.

13. Any person offering their produce for sale on the market may refuse the bid made if it is not satisfactory and no fee is to be charged if no sale is made.

14. Whenever the seller accepts the yellow ticket and drives out of the auction block, the sale is final. The seller and buyer thereby obligate themselves to deliver and accept the produce thus sold to the designated truck or stall. Penalty for violation of this rule is $50.00

15. No changes in tickets are permitted to be made by anyone other than by the employees of the association who are authorized to make such changes. The ticket thus changed will bear an approved stamp.

16. The seller agrees that the association shall deduct fees from the gross amount received for produce sold according to a uniform scale set up by the directors.

17. Large loads of one commodity may be offered for sale whole or in part at the discretion of the seller.

18. The number of sales per load may be limited by management.

19. All buyers who patronize the market must agree to the following:

  • Every buyer upon arrival shall report to the office where they will be assigned a numbered space. The buyer will then proceed according to the yard regulations in the conduct of his business.

  • All buyers, after complying with the yard regulations, will go to the office and make satisfactory financial arrangements with the management.

  • All buyers will offer their bids at the designated auction block and at the call of the auctioneer. Private sales on the grounds are prohibited, unless approved by manager.

  • Buyers must check the load and count and have all complaints adjusted when the seller makes deliver.

  • All purchases must be paid for at the office of the association before the produce is removed from the market property. In case that a buyer wishes to leave produce on the lot overnight, said produce must be paid for before the office closes for the day.

20. The following regulations apply to both buyers and sellers: All proven cases of deception discovered before the buyer leaves the grounds shall be brought to the attention of the auction manager who shall make an equitable adjustment or cancel the sale.

21. Any person, buyer or seller, who willfully violates the rules and regulations of the market may be suspended from the market by the management. Any person with rights thus suspended may have the right of appeal to the Board of Directors.
